Terms of Use
These terms govern your access to and use of PickMySoft. By using the platform you agree to be bound by them. Please read them carefully.
Definitions
In these Terms, the following words and phrases have the meanings set out below:

| Buyer | A User who uses the Platform to research, compare, or procure software for business purposes. |
| Vendor | A software company or individual whose product is listed or managed on the Platform. |
| Reviewer | A User who submits a written review of a software product. |
| Content | All text, data, images, reviews, ratings, scores, listings, and other material on the Platform. |
| User Content | Any content submitted to the Platform by a User, including reviews, profile data, and messages. |
| PickMySoft Score | An editorial score (0–10) assigned to software products by the PickMySoft editorial team independently of any commercial relationship. |
| Services | Software discovery, comparison, review, and lead-generation services provided by PickMySoft. |
| Account | A registered user or vendor account on the Platform. |
| Intellectual Property | Patents, trademarks, service marks, copyrights, design rights, database rights, and all other proprietary rights. |
License to Access
Subject to your compliance with these Terms, PickMySoft grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purpose of business software discovery and evaluation. This licence does not include:
- Reselling or commercially exploiting any part of the Platform or its Content.
- Systematically downloading, scraping, or copying Content to compile a database or directory.
- Reproducing, duplicating, copying, or otherwise exploiting any part of the Platform for any commercial purpose without prior written consent.
- Framing or mirroring any material on the Platform without our express written consent.
- Using automated tools, bots, crawlers, or spiders to access the Platform except with our prior written approval for legitimate indexing purposes.
The Platform is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee uninterrupted or error-free access.
User Account & Security
Where the Platform requires you to create an Account, you agree to:
- Provide accurate, current, and complete registration information.
- Maintain the security of your password and accept responsibility for all activity that occurs under your Account.
- Notify us immediately at hello@pickmysoft.com of any unauthorised use of your Account or any breach of security.
- Not share your Account credentials with any third party.
- Not create multiple Accounts to circumvent restrictions or manipulate platform metrics.
PickMySoft reserves the right to suspend or terminate any Account that we reasonably believe is being used fraudulently, in violation of these Terms, or in a manner harmful to the Platform or its users.
Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your personal data as described in the Privacy Policy. You are responsible for reviewing the Privacy Policy periodically for updates.
Where Users submit personal data of third parties (for example, a colleague’s contact details when requesting a group demo), you warrant that you have obtained all necessary consents from those individuals for us to process their data as described in our Privacy Policy.
Data Processing by Vendors
Where a Buyer submits a lead or enquiry through the Platform, PickMySoft acts as a data controller in collecting that data and as a data processor in forwarding it to the relevant Vendor. The Vendor then becomes an independent data controller in respect of that personal data.
Vendors who receive personal data via the Platform agree to:
- Process such data only for the purpose of responding to the Buyer’s enquiry.
- Maintain appropriate technical and organisational security measures to protect personal data.
- Comply with all applicable data protection laws, including the UK GDPR, EU GDPR, and CCPA where applicable.
- Not sell, share, or otherwise transfer the Buyer’s personal data to any third party without the Buyer’s explicit consent.
- Respond to any data subject requests made by Buyers in respect of their personal data within the legally required timeframes.
Vendors acknowledge that failure to comply with this clause may result in the removal of their listing from the Platform and, where required by law, notification to the relevant supervisory authority.
Reviewer Guidelines
Reviews are the foundation of trust on the Platform. To maintain the integrity of our review system, all Reviewers must comply with the following guidelines. Reviews that violate these guidelines will be removed and repeat offenders may have their Accounts terminated.
6.1 Identity Verification
Reviewers must be genuine users of the software they review. You must have used the software in a professional or business capacity. We reserve the right to request verification of your identity, employment, or use of the product before publishing or after publication. Reviews submitted with false identity information will be removed and may be reported to relevant authorities.
6.2 Conflict of Interest
You must disclose any material relationship with the software vendor at the time of submission. Prohibited reviewers include:
- Current or former employees, contractors, or consultants of the vendor or any of its competitors.
- Investors, shareholders, or board members of the vendor or its parent company.
- Individuals who have received payment, free extended licences, discounts, or other non-standard benefits in exchange for a review — unless such benefits are publicly disclosed in the review text.
- Family members or close personal associates of vendor employees or executives.
6.3 Content Standards
Reviews must:
- Reflect a genuine, first-hand experience with the software.
- Include substantive pros and cons of at least 50 characters each.
- Be written in the reviewer’s own words — plagiarism or AI-generated boilerplate content is prohibited.
- Not contain defamatory, harassing, threatening, obscene, or illegal content.
- Not include the vendor’s or a competitor’s trademark in a manner that is misleading.
- Not include links to external websites.
- Not reveal confidential information, trade secrets, or personally identifiable information of third parties.
6.4 Voucher & Incentive Policy
PickMySoft may, from time to time, run incentivised review campaigns (e.g., gift card draws) to encourage honest reviews. Participation in such campaigns does not entitle the Reviewer to a positive review outcome and does not influence our editorial decisions. Where an incentive was offered, the review will be labelled accordingly. Reviewers must not solicit or accept direct payments or benefits from vendors in exchange for reviews outside of a disclosed, platform-run campaign.
Vendor Guidelines
Vendors benefit from the trust and credibility of the PickMySoft platform. To protect that credibility — which ultimately benefits all Vendors — the following rules apply absolutely.
7.1 No Review Manipulation
Vendors must not directly or indirectly attempt to influence, incentivise, or solicit reviews in a manner that distorts the honest opinion of Reviewers. Prohibited conduct includes but is not limited to:
- Offering discounts, extensions, upgrades, gifts, or any other benefits contingent on a positive review outcome.
- Directing customers exclusively to leave reviews when those customers are known to be highly satisfied, thereby creating a systematically biased sample (“cherry-picking”).
- Using a review invitation service to filter out likely-negative reviewers before they reach the platform.
- Coordinating or coaching customers on specific language or star ratings to use in their reviews.
7.2 No Self-Reviews
Vendors, their employees, contractors, affiliates, investors, and family members are strictly prohibited from submitting reviews of their own products or the products of direct competitors. PickMySoft employs technical and human review processes to detect fraudulent reviews and will remove them without notice. Accounts associated with self-review activity will be permanently banned.
7.3 No Reviewer Harassment
Vendors must not contact, pressure, threaten, or intimidate any Reviewer in connection with the content of their review, whether before or after publication. Where a Vendor has a factual dispute with a review, the correct channel is our formal review dispute process (see below). Any attempt to resolve disputes directly with Reviewers outside this process — particularly if it involves threats of legal action — will be treated as a serious violation of these Terms.
7.4 Review Investigation Process
Vendors may submit a review dispute request to editorial@pickmysoft.com if they believe a published review is fraudulent, contains factually incorrect information, or violates our content guidelines. Disputes must include: (a) the review URL and reviewer name, (b) specific factual claims alleged to be false, (c) supporting evidence. PickMySoft will investigate within 10 business days and communicate its decision. The outcome may be: no action, amendment of specific factual errors, or removal of the review. Our editorial decision is final. Vendors must not abuse the investigation process by raising disputes about reviews that are merely unflattering but contain no factual inaccuracies or guideline violations.
Eligibility
The Platform is intended for business use. By using the Platform you represent and warrant that:
- You are at least 18 years of age and have legal capacity to enter into binding agreements.
- If you are using the Platform on behalf of a company or other legal entity, you have authority to bind that entity to these Terms.
- Your use of the Platform does not violate any applicable law, regulation, or court order in your jurisdiction.
- You have not been previously banned or suspended from the Platform.
PickMySoft is a global platform. We do not represent that the Services are appropriate or available in all jurisdictions. It is your responsibility to ensure that your use of the Platform complies with local laws.
Prohibited Activities
You agree not to, and will not assist others to:
- Post false, misleading, fraudulent, defamatory, or harassing content.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Submit malware, viruses, Trojan horses, or any other malicious code.
- Attempt to gain unauthorised access to any part of the Platform or its infrastructure.
- Use the Platform to send unsolicited commercial communications (spam).
- Collect personal information about other Users without their consent.
- Interfere with or disrupt the integrity or performance of the Platform or its services.
- Circumvent, disable, or otherwise interfere with security features.
- Use the Platform in any manner that could damage, disable, overburden, or impair it.
- Access the Platform via automated means (scraping, bots) except as expressly permitted.
- Engage in any activity that violates applicable export control or sanctions laws.
- Manipulate pricing data, ratings, or any other metrics on the Platform.
User Submissions
By submitting any User Content to the Platform — including reviews, questions, comments, or vendor listing data — you grant PickMySoft a worldwide, perpetual, irrevocable, royalty-free, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media for the purposes of operating and promoting the Platform.
You warrant that you own or control all rights in the User Content you submit, that the User Content is accurate, that it does not violate these Terms, and that use of the User Content will not infringe any third-party rights or cause injury to any person or entity.
PickMySoft does not endorse User Content and takes no responsibility for it. We reserve the right (but not the obligation) to monitor, edit, or remove any User Content at our sole discretion and without notice. Removal of User Content does not constitute an admission of any wrongdoing by PickMySoft.
Third-Party Links
The Platform contains links to third-party websites, including software vendor websites, affiliate partners, and external resources. These links are provided for convenience only. PickMySoft has no control over the content, privacy practices, or availability of such websites and is not responsible or liable for them. The inclusion of any link does not imply endorsement by PickMySoft. You access third-party websites entirely at your own risk.
Some links on the Platform may be affiliate links through which PickMySoft earns a commission if you purchase a product. Such links are identified where required by applicable advertising standards. Affiliate relationships do not influence editorial scores, rankings, or review content.
Modification of Software Listings
PickMySoft reserves the right to add, modify, or remove any software listing from the Platform at any time and without prior notice. Reasons may include but are not limited to:
- The software has been discontinued or is no longer commercially available.
- The vendor has submitted false or misleading information.
- The listing violates our editorial standards or these Terms.
- We have received credible reports of fraudulent or harmful vendor practices.
- Legal obligations require us to do so.
Vendors with paid listings who have their listing removed due to a violation of these Terms are not entitled to a refund of any fees paid. Vendors who believe their listing was removed in error may contact vendors@pickmysoft.com.
Copyright & Intellectual Property
All intellectual property rights in the Platform and its Content (excluding User Content) are owned by or licensed to PickMySoft. This includes, without limitation, the PickMySoft name and logo, the PickMySoft Score methodology, site design, editorial content, category taxonomy, and all software underlying the Platform.
You may not copy, reproduce, republish, upload, post, transmit, or distribute any part of the Platform Content without our prior written consent, except that you may:
- Print or download a single copy of any page for personal, non-commercial reference only.
- Share links to Platform pages on social media or in written communications, provided you do not imply any endorsement or affiliation.
If you believe that any content on the Platform infringes your copyright, please contact us at legal@pickmysoft.com with the following information: (a) a description of the copyrighted work, (b) the URL of the allegedly infringing material, (c) your contact information, and (d) a statement that you have a good faith belief that the use is not authorised. We will investigate and respond within 10 business days.
Termination
Either party may terminate the relationship governed by these Terms at any time. You may stop using the Platform and close your Account at any time. PickMySoft may suspend or permanently terminate your access to the Platform immediately and without notice if:
- You have breached any provision of these Terms.
- We are required to do so by law or court order.
- Your conduct is harmful to other Users, third parties, or PickMySoft’s business.
- Continued provision of the Services to you is no longer commercially viable.
Upon termination, your licence to use the Platform ceases immediately. Clauses that by their nature should survive termination (including Intellectual Property, Disclaimer & Liability, Governing Law, and User Submissions) shall continue in full force and effect after termination.
Force Majeure
PickMySoft shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure is caused by circumstances beyond our reasonable control. This includes, without limitation: acts of God, pandemics, natural disasters, war, terrorism, civil unrest, government action, power failures, internet outages, third-party service failures (including cloud infrastructure providers), cyberattacks, or labour disputes.
In the event of a force majeure event, PickMySoft will use reasonable endeavours to notify affected Users and to resume normal service as soon as reasonably practicable.
Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Before bringing any formal legal proceedings, you agree to contact us at legal@pickmysoft.com to attempt to resolve the dispute informally. We will endeavour to respond within 15 business days.
If informal resolution is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts of India. Users in the European Economic Area or United Kingdom may also refer disputes to their local consumer protection authority or, for GDPR-related complaints, to their relevant data protection supervisory authority.
Disclaimer & Limitation of Liability
No warranty.The Platform and its Content are provided “as is” and “as available” without any warranty, express or implied. PickMySoft does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses. We do not endorse or warrant the accuracy of any software listing, vendor claim, user review, or editorial score.
No purchasing advice. Information on the Platform is provided for general research purposes only and does not constitute professional, legal, financial, or procurement advice. All purchasing decisions remain solely the responsibility of the Buyer. PickMySoft is not a party to any contract between a Buyer and a Vendor.
Limitation of liability. To the maximum extent permitted by applicable law, PickMySoft and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim under these Terms shall not exceed the greater of: (a) any amounts you have paid PickMySoft in the 12 months preceding the claim, or (b) USD 100.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Changes to These Terms
PickMySoft reserves the right to update or modify these Terms at any time. When we make material changes, we will: (a) update the “Last updated” date at the top of this page, and (b) where reasonably practicable, notify registered Account holders by email or via a prominent notice on the Platform.
Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform. We encourage you to review these Terms periodically.
